Article 1 โ€” Who You Are Contracting With

1.1 These Terms and Conditions ("Terms") govern your purchase and use of the aviation training products and services ("Products") offered through www.peakaviation.eu ("Website") and the Peak Aviation mobile application ("App"). Please read them carefully before purchasing. By placing an order you confirm you have read, understood, and accepted these Terms.

1.2 Peak Aviation operates as a group of legally separate entities. The company you are contracting with depends on the Product you purchase and is confirmed in your order confirmation email and invoice.

1.3 In these Terms, "we", "us", or "the Company" means the specific contracting entity identified on your order confirmation. No other Peak Aviation entity assumes liability for that contract, and no joint liability exists between Peak Aviation entities unless expressly stated in writing.

1.4 All entities operate under the shared Peak Aviation brand at www.peakaviation.eu.

1.5 EU consumers contracting with our UAE entity. Where your Product is supplied by Peak Aviation FZC LLC (United Arab Emirates), you retain the full protection of the mandatory consumer law of your EU/EEA country of residence. Peak Aviation FZC LLC expressly submits, in your favour, to those mandatory consumer protections and to the dispute-resolution and refund provisions of these Terms, and has appointed Peak Aviation OOD (Sofia, Bulgaria) as its point of contact and as its representative within the EU for the purposes of Article 27 GDPR. Article 2 โ€” Definitions

  • "Student" or "Client" โ€” the individual or legal entity purchasing a Product.
  • "PPL Course" โ€” the Private Pilot Pathway course delivered by Peak Aviation Academy OOD as a Declared Training Organisation (DTO) under EASA Part-FCL.
  • "ELP Test" โ€” the English Language Proficiency assessment delivered by Peak Aviation OOD, in accordance with ICAO Doc 9835 standards. In-person testing is delivered in partnership with Lenguax Ltd (United Kingdom); online (remote) testing is delivered in partnership with a certified EU-based examination partner. Available as an online (remote) examination and as an in-person examination in Sofia, Bulgaria.
  • "ATPL Programme" โ€” the Airline Transport Pilot Licence theoretical knowledge course delivered by Peak Aviation OOD.
  • "Single Subject Modules" โ€” individual aviation theory learning modules sold by Peak Aviation FZC LLC, accessible to the general public. These do not form part of an EASA DTO-regulated training programme unless combined with a Certification Module.
  • "Certification Module" โ€” the EASA DTO-regulated examination and certification component delivered by Peak Aviation Academy OOD, required for formal EASA Part-FCL licence progression.
  • "LMS" โ€” the Learning Management System through which digital course content is delivered.
  • "EASA" โ€” the European Union Aviation Safety Agency.
  • "DTO" โ€” Declared Training Organisation, as defined under Commission Regulation (EU) 2018/1119.
  • "Consumer" โ€” a natural person acting for purposes outside their trade, business, or profession.
  • "Digital Content" โ€” content supplied in digital form (e.g. video lessons, mock exams, downloadable materials and ebooks), and "digital service" has the meaning given in Directive (EU) 2019/770.
  • "Business Day" โ€” any day other than Saturday, Sunday, or a Bulgarian public holiday.
  • "NAA" โ€” National Aviation Authority โ€” the competent civil aviation authority in your country of residence or licence registration.

Article 3 โ€” Enrolment and Contract Formation

3.1 A binding contract is formed when: (a) you submit a valid order through the Website, and (b) payment is successfully processed and you receive an order confirmation email from us.

3.2 We reserve the right to refuse or cancel an order if: fraud, unauthorised payment, or a chargeback dispute is suspected; you do not meet stated eligibility requirements for the Product; regulatory or capacity constraints prevent delivery; or a material pricing or technical error occurred on the Website. If we cancel for any of these reasons, you receive a full refund within 14 days.

3.3 All Products are delivered and supported in English unless explicitly stated otherwise on the product page.

3.4 Capacity limits. We may limit enrolment numbers. The Private Pilot Pathway is capped at 50 students per year. If a cohort is full at the time of your purchase, you will be notified and offered either a place on the next available cohort or a full refund.

3.5 Right of Withdrawal โ€” Digital Content (EU Consumers). EU/EEA consumers have a statutory 14-day right of withdrawal from distance contracts. For digital content and digital services supplied immediately, that right is lost under Article 16(m) of Directive 2011/83/EU only where, before purchase, you (a) give express prior consent to immediate performance, (b) acknowledge that you will lose your right of withdrawal once performance begins, and (c) receive confirmation of that agreement. Our checkout obtains this consent. Independently of that statutory position, our 14-Day Confidence Guarantee in Article 5.3 grants you the refund rights described below. Not sure yet? Article 4 โ€” Pricing and Payment

4.1 All prices are displayed in Euros (EUR). For B2C sales, VAT is either included in the displayed price or added at checkout. Your invoice confirms the VAT treatment.

4.2 VAT is applied as follows: B2C EU customers โ€” VAT at the rate of your country of residence under the EU One Stop Shop (OSS) scheme; B2B EU customers with a valid VAT number โ€” 0% VAT, reverse charge under Article 196 of the EU VAT Directive (2006/112/EC), you self-account in your jurisdiction; Non-EU customers โ€” VAT may not apply, depending on applicable law.

4.3 You are responsible for providing accurate billing and VAT information. We are not liable for incorrect VAT treatment resulting from inaccurate information you provide, and may issue a correcting invoice where additional VAT becomes payable.

4.4 Reference prices and discounts. Where we advertise a reduced price against a higher "usual" price, the higher price shown is the lowest price we applied during the 30 days before the reduction, in accordance with Article 6a of Directive 98/6/EC (as amended).

4.5 Accepted payment methods are shown at checkout and vary by Product. They may include credit/debit card, Apple Pay, Google Pay, SEPA Direct Debit, bank transfer, and cryptocurrency.

4.6 Cryptocurrency payments. Once confirmed on the blockchain, a cryptocurrency transaction is final and non-reversible. We accept no liability for funds sent to an incorrect wallet address or for exchange-rate fluctuations. This does not affect any refund you are entitled to under Article 5; such refunds are paid in EUR to a bank account or card you provide. VAT invoices for crypto payments are denominated in EUR at the exchange rate at the moment of blockchain confirmation.

4.7 Invoices are issued by the relevant contracting entity and sent to your checkout email. Keep a copy for your records.

Article 5 โ€” Cancellations and Refunds

5.1 Your Statutory Right of Withdrawal (EU Consumers)

If you are a Consumer in the EU/EEA, you have a legal right to withdraw from a distance contract without giving any reason within 14 days, subject to the exceptions below. To exercise it, email [email protected] with your order details, or use the model withdrawal form available on request. We process eligible refunds within 14 days of being informed, using your original payment method unless you agree otherwise.

5.2 Exceptions to the Right of Withdrawal

  • Digital Content and digital services are delivered immediately on purchase. Where you have given the consent described in Article 3.5, the strict statutory withdrawal right is lost once performance begins. The refund rights that apply in its place are set out in Article 5.3.
  • In-person services. For in-person ELP tests, you lose the right to withdraw once the examination is fully performed within the 14-day period, provided you gave express consent to the service commencing within that period.

5.3 Product-Specific Cancellation Policies

Private Pilot Pathway & ATPL Programme โ€” Our 14-Day Confidence Guarantee

Your 14-day window starts on the date of purchase.

(a) Haven't started yet โ€” refund less the non-recoverable payment fee. If, within 14 days of purchase, you have not accessed any content, we will refund the amount you paid, less only the payment-processing fee that our payment provider charged on your transaction and does not return to us when we issue a refund. That fee depends on the card or method you used and is typically between 2% and 6%ย on a Private Pilot Pathway purchase; we will tell you the exact amount retained on request. No other deduction is made. Where the mandatory consumer law of your EU/EEA country of residence entitles you to a larger refund, that entitlement prevails.

(b) Started, but not the right fit โ€” 40% goodwill refund. If, within 14 days of purchase, you have accessed some content but decide the course is not right for you, we will refund 40% of the amount you paid as a voluntary goodwill gesture. This goes beyond what EU law strictly requires, because by expressly requesting immediate performance at checkout and then accessing content you released us from the statutory refund obligation.

(c) After 14 days โ€” no refund, except: where we cancel the service (clause 5.4); where the mandatory consumer law of your country of residence provides otherwise; where we have materially failed to deliver the Product; or where you have a remedy for non-conformity under Article 5.6.

Single Subject Modules (โ‚ฌ99) โ€” 14-Day Confidence Guarantee

Haven't opened it within 14 days? Full refund, less only the non-recoverable payment-processing fee on your transaction (typically between 2% and 6%). Started it? 40% goodwill refund within 14 days. After 14 days: no refund, subject to the same exceptions in 5.3(c) above.

How we measure "content accessed." Access is recorded by our LMS and by the systems of the content providers used to deliver your course, including the ebook reader through which your digital books are supplied. "Accessed" means one or more of the following has been logged for your account: opening a lesson page; starting or completing a video; opening, downloading, or launching an ebook or downloadable file; attempting a quiz; or posting in the community area linked to the course. Viewing the public outline, preview, or trailer does not count.

How to request a refund. Email [email protected] from the address on your order, subject line "Refund request โ€” order #[number]". We acknowledge within 5 Business Days, verify your activity across the LMS and associated content providers, confirm which tier applies, and refund to your original payment method within 14 days of approval. For crypto purchases, refunds are issued in EUR to a bank account or card you provide.

This does not limit your mandatory consumer rights. If the law of your EU/EEA country of residence gives you a stronger right, that stronger right applies.

Online ELP Tests โ€” Cancellation more than 72 hours before the exam: full refund. Within 72 hours: no refund; one free reschedule with at least 72 hours' notice. No-show: no refund. Technical failure attributable to Peak Aviation: full refund or free reschedule at your choice.

In-Person ELP Tests (Sofia) โ€” Cancellation more than 7 days before: full refund. 3โ€“7 days before: 50% refund. Less than 72 hours before, or no-show: no refund. One free reschedule with at least 7 days' notice, subject to examiner availability.

5.4 Cancellation by Us

If we cancel a Product due to insufficient enrolment, instructor unavailability, or regulatory changes, you receive a full refund within 14 days. We are not liable for other costs you may have incurred (e.g. travel, accommodation, annual leave).

5.5 Refund Processing

All refunds are returned to the original payment method within 14 days. For crypto payments, refunds are issued in EUR to a bank account or card you provide, as crypto transactions are irreversible.

5.6 Your Right to Conforming Digital Content (Directive (EU) 2019/770)

Separately from your withdrawal and refund rights, we are legally required to supply Digital Content and digital services that conform to the contract โ€” of the described quality and fit for their intended purpose. If content is not in conformity, you are entitled to have it brought into conformity and, where that is not done within a reasonable time or is impossible, to a proportionate price reduction or to terminate for a refund of the affected amount. For the period required by law, it is for us โ€” not you โ€” to show the content was conforming when supplied. These rights are free of charge and additional to any other remedy.

Article 6 โ€” Online ELP Examination Terms

Online (remote) ELP examinations are delivered in partnership with a certified Language Test Body established in the EU/EEA, operating under the oversight of its national aviation authority in accordance with ICAO Doc 9835 standards and EASA Part-FCL (including FCL.055). Peak Aviation OOD is your contracting party for the booking; our examination partner delivers and rates the examination through its secure testing platform.

6.1 Technical Requirements

To sit an online ELP examination you must have: a stable internet connection (minimum 5 Mbps upload and download); a working webcam and microphone; a quiet, private space with no other persons present; and a valid, in-date government photo ID. It is your responsibility to ensure your equipment and environment meet these requirements. We are not responsible for examination failure or termination caused by technical issues on your side.

6.2 Examination Conduct

The examiner may terminate the examination and void the result, without refund, if: a third party is present or assisting; you cannot verify your identity; technical conditions on your side prevent proper administration; or your conduct violates examination integrity (including use of notes, scripts, earpieces, or AI assistance tools).

6.3 Results

Results are communicated by email within 10 Business Days of the examination date.

6.4 Documentation

We deliver and assess to ICAO Doc 9835 standards and applicable EASA and national regulations. On a passing result we issue documentation suitable for submission to your NAA. Because licensing decisions rest solely with each authority, we cannot guarantee acceptance by any specific authority; verify your NAA's current requirements before booking.

6.5 Recording and Privacy

By booking an online examination you acknowledge the session is recorded for quality assurance, regulatory compliance, and fraud prevention. The lawful bases are performance of your examination contract, our legitimate interest in protecting examination integrity, and compliance with our regulatory obligations; where any biometric identity-matching is used we obtain explicit consent separately and you may request a manual alternative. Recordings are retained for 12 months unless a longer period is legally required. See our Privacy Notice for detail, including the data-protection impact assessment we maintain for this activity.

6.6 Data Processing for Online Examinations

To deliver and rate your online ELP examination, your personal data is shared between Peak Aviation OOD and our EU-based examination partner under a data processing agreement. The data processed includes your name, email, telephone number, date of birth, licence number, address, the audio recording of your session, and your scores and timing logs. As our examination partner is established in the EU/EEA, no third-country transfer arises and your data remains protected under the GDPR throughout. Article 6A โ€” In-Person ELP Examination Terms (Sofia)

In-person ELP testing is delivered as the Test of English for Aeronautical Communication (TEAC), in partnership with Lenguax Ltd, a company registered in England (company number 12512848), registered office 2 Mayfield Avenue, Peacehaven, East Sussex BN10 8PB, United Kingdom, a certified provider of aeronautical English assessment. Examinations are administered and rated to ICAO Doc 9835 standards and applicable EASA and national regulations. Peak Aviation OOD operates as the authorised test centre administering the TEAC on Lenguax's behalf in Sofia.

6A.1 Location. Puzl CoWorking, Business Centre Vitosha, Cherni Vrah 47A Blvd., Sofia 1407, Bulgaria. Parking and transport information is included in your booking confirmation.

6A.2 Booking. Book through www.peakaviation.eu; confirmed by email. Bookings are personal to you and non-transferable.

6A.3 What to bring. A valid, in-date government photo ID (expired documents are not accepted); any pilot or student licence or training documentation if requested in your confirmation.

6A.4 Punctuality. Arrive at least 15 minutes early. Arriving more than 15 minutes late may forfeit the examination at the examiner's discretion, with no refund. If running late, contact us immediately.

6A.5 Conduct. The examiner may terminate the examination and void the result, without refund, if: you fail to present valid ID; your conduct violates integrity (notes, scripts, devices); you are visibly impaired; or a third party interferes.

6A.6 Results and documentation. Communicated by email within 10 Business Days. We deliver and assess to ICAO Doc 9835 and applicable national regulations; on a passing result we provide documentation suitable for your NAA. We cannot guarantee acceptance by any specific authority.

6A.7 Examiner substitution. We may substitute a qualified examiner where necessary. If no qualified replacement is available, you are offered a free reschedule or a full refund.

6A.8 Accessibility. Contact us at least 7 Business Days before your appointment for reasonable adjustments. Requests made later will be accommodated where possible but cannot be guaranteed.

6A.9 Cancellation. See Article 5.3 (In-Person ELP Tests).

6A.10 Data processing. To deliver and certify your TEAC examination, your personal data is shared between Peak Aviation OOD and Lenguax Ltd under a contract for services. For booking, identity verification, and attendance, Peak Aviation OOD is data controller; for administration, rating, and certification of the TEAC, Lenguax acts as controller and/or processor depending on the data flow, as described in its own privacy notice. Data processed includes your name, nationality, first language, ID document type and number, email and postal address, aviation role, telephone number, and a photograph, stored by Lenguax on secure servers in the United Kingdom (which benefits from a European Commission adequacy decision). The diagnostic component involves an element of automated language-level evaluation; this does not produce a binding decision on its own, your final result is determined with human rating, and you may request reconsideration. Where legally required, Lenguax may confirm the authenticity of your TEAC certification to a competent authority. Lenguax's privacy notice is at www.lenguax.com/privacy-policy; it is regulated by the UK ICO ([email protected]). Our own processing is described at www.peakaviation.eu/privacy-policy.

Article 7 โ€” Your Responsibilities

7.1 Eligibility verification. You are responsible for verifying, before purchase: your eligibility for the licence, rating, or certificate you seek; applicable medical certification (e.g. EASA Part-MED Class 2 medical for PPL); and your NAA's current requirements. We do not provide eligibility assessments.

7.2 No guarantee of outcomes. Completing a course or passing an examination does not guarantee any licence, rating, qualification, or employment. Licensing decisions are made solely by your NAA.

7.3 Account security. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of suspected unauthorised access.

7.4 Prohibited conduct. You must not: share your login or grant account access to anyone else; reproduce, distribute, record, or commercially exploit course materials or examination content; use AI tools, scripts, notes, or third-party assistance during examinations; access the Service via bots, crawlers, or automated means; scrape, harvest, or index any content (including the question bank); bypass or circumvent any access control or digital-rights-management measure; reverse-engineer or attempt to extract source code or content files; use framing, mirroring, bulk download, or archiving not expressly permitted; or create derivative works from our content, including translations, AI voice-overs, subtitle files, or versions with altered branding. Where we suspend or terminate access for a serious breach attributable to you, no refund is due for the affected Product; this does not affect refunds or remedies you have by law. Serious breaches may be reported to the relevant NAA or law enforcement.

Article 8 โ€” Intellectual Property and Licence to Use

8.1 All course content, materials, brand assets, examination questions, software, and other intellectual property are owned by Peak Aviation FZC LLC or licensed to the relevant contracting entity, and are protected by copyright and other laws. Nothing in these Terms transfers any intellectual property rights to you. The content is licensed, not sold, to you.

8.2 Your licence. On payment, you are granted a personal, non-exclusive, non-transferable, revocable licence to access and use the course materials solely for your own private, non-commercial training, for the access period stated on the product page. Unless otherwise stated, access to PPL Pathway materials is valid for 36 months from purchase; continued access after expiry requires re-enrolment at the prices and terms then in force.

8.3 Personal use only. You confirm you are a natural person using the materials for your own training. The licence does not permit use in commercial premises or non-private settings, for the tuition of others, or any copying, lending, leasing, resale, or redistribution. You must not circumvent, disable, or defeat any access-control or copy-protection measure. We monitor for activity indicating account sharing or unauthorised use and may suspend access where we reasonably detect it.

8.4 We may apply technical protection measures, including digital watermarking, session tracking, and access controls.

8.5 If you submit feedback, suggestions, or ideas about our Products, we may use them freely without obligation or compensation to you.

8.6 Enforcement. Unauthorised copying, sharing, scraping, indexing, framing, mirroring, reverse-engineering, or creation of derivative works (including translations, AI voice-overs, subtitles, or re-branding) of our content may cause irreparable harm for which monetary damages alone would be an inadequate remedy. We therefore reserve the right to seek injunctive relief, in addition to damages and recovery of reasonable legal costs, to the fullest extent permitted by applicable law.

Article 9 โ€” Data Protection and Privacy

9.1 We process personal data in accordance with the GDPR (Regulation (EU) 2016/679) and applicable Bulgarian data protection legislation.

9.2 Our Privacy Notice (www.peakaviation.eu/privacy-policy) sets out what we collect, why, how long we keep it, who we share it with, and how to exercise your rights. By purchasing a Product you confirm you have read it.

9.3 Your GDPR rights include access, rectification, erasure, restriction, objection, and portability. To exercise them, email [email protected].

9.4 You may lodge a complaint with your national supervisory authority. In Bulgaria: Commission for Personal Data Protection (CPDP / ะšะ—ะ›ะ”), www.cpdp.bg.

9.5 Where personal data is transferred outside the EU โ€” for example to Peak Aviation FZC LLC (UAE) โ€” we ensure appropriate safeguards under GDPR Chapter V, including EU Standard Contractual Clauses (Art. 46). Peak Aviation OOD acts as the Article 27 EU representative of Peak Aviation FZC LLC.

Article 10 โ€” Limitation of Liability

10.1 Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) your mandatory rights and remedies as a Consumer, including remedies for non-conforming Digital Content under Article 5.6; or (d) any liability that cannot lawfully be excluded under applicable law.

10.2 Subject to 10.1, our liability for any indirect, consequential, or special loss is excluded, and our total aggregate liability for any specific Product will not exceed the total amount you paid for that Product. Nothing here limits the value of a refund or price reduction you are entitled to by law.

10.3 Subject to 10.1, we are not liable for: any NAA decision regarding your licence, rating, or application; any examination or assessment outcome; any career, employment, or commercial consequence; or technical failures caused by your own equipment, internet connection, or by third-party platforms, payment providers, and content providers on which the Service depends and which are outside our control.

10.4 Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, pandemics, government or regulatory action affecting aviation training, strikes, third-party platform or content-provider outages, or widespread internet disruption. Where such an event prevents performance, we notify you promptly and, where performance is ultimately impossible, offer a reschedule or a full refund for the affected Product.

Article 11 โ€” Governing Law and Dispute Resolution

11.1 These Terms, and any contract under them, are governed by the laws of the Republic of Bulgaria.

11.2 EU Consumer protection prevails in your favour. If you are a Consumer resident in an EU/EEA member state, this choice of Bulgarian law does not deprive you of the protection of mandatory provisions of the law of your country of residence. Where your local mandatory consumer protection is stronger, it applies in addition to, and prevails over, Bulgarian law to the extent of any conflict.

11.3 Our dispute process: Step 1 โ€” email [email protected]; we acknowledge within 2 Business Days and aim to resolve within 14 Business Days. Step 2 โ€” if unresolved, you may refer the matter to the Bulgarian Commission for Consumer Protection (ะšะ—ะŸ, www.kzp.bg) or to an approved consumer-dispute or ADR body in your EU/EEA country of residence (directory: consumer-redress.ec.europa.eu/dispute-resolution-bodies). We are willing to participate in ADR before the Bulgarian consumer arbitration body. Step 3 โ€” failing resolution, disputes go to the competent courts in Sofia, Bulgaria, without prejudice to your right as an EU Consumer to bring proceedings in your country of residence.

Article 12 โ€” Changes to These Terms

12.1 We may update these Terms to reflect changes in our Products, services, or applicable law. 12.2 For material changes we give at least 30 days' written notice by email. 12.3 If you do not accept a material change you may cancel before it takes effect; where you have prepaid for unused access we provide a pro-rata refund. 12.4 Continued use after a material change takes effect constitutes acceptance. 12.5 The current version is always at www.peakaviation.eu/terms-and-conditions; the version date confirms which applies to your contract.

Article 13 โ€” Contact and Complaints

13.1 We aim to acknowledge complaints within 2 Business Days and respond substantively within 14 Business Days. 13.2 Email [email protected] or use www.peakaviation.eu/contact. 13.3 If unsatisfied, contact the Bulgarian Commission for Consumer Protection (ะšะ—ะŸ, www.kzp.bg) or the consumer-protection or ADR authority in your EU/EEA country of residence (directory: consumer-redress.ec.europa.eu/dispute-resolution-bodies), or seek independent legal advice.

Article 14 โ€” Indemnification

To the fullest extent permitted by applicable law, and except to the extent your liability cannot lawfully be excluded (including your rights as a Consumer), you agree to indemnify and hold harmless Peak Aviation, its entities, directors, employees, contractors, licensors, and service providers from any third-party claim, demand, or reasonable legal cost arising out of: (a) your breach of these Terms; (b) your misuse of the Service or content; (c) your infringement of any intellectual-property or other right of a third party; or (d) content you post in any community area. This clause does not require you to indemnify us against our own negligence or wrongdoing, and does not affect your mandatory rights as a Consumer.

Article 15 โ€” Community Areas
