Article 1 — Who You Are Contracting With
1.1 These Terms and Conditions ("Terms") govern your purchase and use of aviation training products and services ("Products") offered through www.peakaviation.eu ("Website"). Please read them carefully before purchasing.
1.2 Peak Aviation operates as a group of legally separate entities. The company you are contracting with depends on the product you purchase, and is confirmed in your order confirmation email and invoice. The table below provides a full overview.
1.3 In these Terms, "we", "us", or "the Company" means the specific contracting entity identified on your order confirmation. No other Peak Aviation entity assumes liability for that contract, and no joint liability exists between Peak Aviation entities unless expressly stated in writing.
1.4 All three entities operate under the shared Peak Aviation brand at www.peakaviation.eu.

Article 2 — Definitions
In these Terms, the following words have these meanings:
- "Student" or "Client" — the individual or legal entity purchasing a Product.
- "PPL Course" — the Private Pilot Pathway course delivered by Peak Aviation Academy OOD as a Declared Training Organisation (DTO) under EASA Part-FCL.
- "ELP Test" — the English Language Proficiency assessment delivered by Peak Aviation OOD, in partnership with Lenguax s.r.o. (Slovakia), in accordance with ICAO Doc 9835 standards. Available as an online (remote) examination and as an in-person examination in Sofia, Bulgaria.
- "ATPL Programme" — the Airline Transport Pilot Licence theoretical knowledge course delivered by Peak Aviation OOD.
- "Single Subject Modules" — individual aviation theory learning modules sold by Peak Aviation FZC LLC, accessible to the general public. These do not form part of an EASA DTO-regulated training programme unless combined with a Certification Module.
- "Certification Module" — the EASA DTO-regulated examination and certification component delivered by Peak Aviation Academy OOD, required for formal EASA Part-FCL licence progression.
- "LMS" — the Learning Management System (currently Kajabi) through which digital course content is delivered.
- "EASA" — the European Union Aviation Safety Agency.
- "DTO" — Declared Training Organisation, as defined under Commission Regulation (EU) 2018/1119.
- "Consumer" — a natural person acting for purposes outside their trade, business, or profession.
- "Digital Content" — content produced and supplied in digital form (e.g. video lessons, mock exams, downloadable materials).
- "Business Day" — any day other than Saturday, Sunday, or a Bulgarian public holiday.
- "NAA" — National Aviation Authority — the competent civil aviation authority in your country of residence or licence registration.
Article 3 — Enrolment and Contract Formation
3.1 A binding contract is formed when: (a) you submit a valid order through the Website, and (b) payment is successfully processed and you receive an order confirmation email from us.
3.2 We reserve the right to refuse or cancel an order if:
- fraud, unauthorised payment, or a chargeback dispute is suspected;
- you do not meet stated eligibility requirements for the product;
- regulatory or capacity constraints prevent us from delivering the product;
- a material pricing or technical error occurred on the Website.
If we cancel your order for any of the above reasons, you will receive a full refund within 14 days.
3.3 All products are delivered and supported in English unless explicitly stated otherwise on the product page.
3.4 Capacity limits: We may limit enrolment numbers. The Private Pilot Pathway is capped at 50 students per year. If a cohort is full at the time of your purchase, you will be notified and offered either a place on the next available cohort or a full refund.
3.5 Right of Withdrawal — Digital Content (EU Consumers). EU/EEA consumers have a statutory 14-day right of withdrawal from distance contracts. For the digital courses supplied by us, that right is displaced under Art. 16(m) of Directive 2011/83/EU only where you expressly request immediate performance and acknowledge that you thereby lose the right once performance begins. Our 14-day satisfaction policy in Article 5.3 preserves in your favour a full refund where no content has been accessed and offers a 50% goodwill refund where some content has been accessed. Article 4 — Pricing and Payment
4.1 All prices are displayed in Euros (EUR). For B2C sales, VAT is either included in the displayed price or added at checkout. Your invoice will confirm the VAT treatment applicable to your order.
4.2 VAT is applied as follows:
- B2C EU customers: VAT is charged at the rate applicable in your country of residence, in accordance with the EU One Stop Shop (OSS) scheme.
- B2B EU customers with a valid VAT number: 0% VAT. The reverse charge mechanism applies under Article 44 of the EU VAT Directive. You are responsible for self-accounting for VAT in your jurisdiction.
- Non-EU customers: VAT may not apply, depending on applicable law.
4.3 It is your responsibility to provide accurate billing and VAT information at checkout. We are not liable for incorrect VAT treatment resulting from inaccurate information you provide. Where additional VAT becomes payable as a result, we reserve the right to issue a correcting invoice.
4.4 Accepted payment methods are shown at checkout and vary by product. They may include credit/debit card, Apple Pay, Google Pay, SEPA Direct Debit, bank transfer, and cryptocurrency.
4.5 Cryptocurrency payments: Once a cryptocurrency transaction is confirmed on the blockchain, it is final and non-reversible. We accept no liability for funds sent to an incorrect wallet address, or for losses arising from exchange rate fluctuations. VAT invoices for crypto payments are denominated in EUR at the exchange rate at the moment of blockchain confirmation.
4.6 Invoices are issued by the relevant contracting entity and sent to the email address you provided at checkout. Keep a copy for your records.
Article 5 — Cancellations and Refunds
5.1 Your Statutory Right of Withdrawal (EU Consumers)
If you are a Consumer in the EU, you have a legal right to withdraw from a contract without giving any reason within 14 days of purchase, subject to the exceptions below. To exercise this right, email us at [email protected] with your order details. We will process your refund within 14 days.
5.2 Exceptions to the Right of Withdrawal
- Digital Content. Digital products are delivered immediately on purchase. The terms that apply in place of, and partly in substitution for, the strict statutory withdrawal right are set out in Article 5.3 (14-day satisfaction policy).
- In-Person Services: For in-person ELP tests, you lose the right to withdraw if the examination is fully completed within the 14-day period, provided you gave express consent to the service commencing within that period.
5.3 Product-Specific Cancellation Policies
PPL Pathway/ Single Subject Modules and ATPL Programme — 14-day satisfaction policy
You enjoy a 14-day satisfaction window that starts on the date of purchase. During this window, the refund you may request is as follows:
(a) Zero content accessed — 100% refund. If, within 14 days of purchase, you have not opened any lesson, watched any video, attempted any quiz, or accessed any downloadable material in the Learning Management System (LMS), we will refund 100% of the amount you paid. This is a full refund of your statutory right of withdrawal under the EU Consumer Rights Directive (Art. 9 and Art. 14(4)(b)), preserved in your favour notwithstanding the immediate-performance request made at checkout.
(b) Some content accessed — 50% goodwill refund. If, within 14 days of purchase, you have accessed some content but have decided the course is not right for you, we will refund 50% of the amount you paid as a voluntary goodwill gesture. This goes beyond what EU law strictly requires, because by expressly requesting immediate performance at checkout and then accessing content you released us from the statutory refund obligation.
(c) After 14 days — no refund. After the 14-day window has elapsed, no refund is available, except where we cancel the service (clause 5.4), where applicable mandatory consumer law in your country of residence provides otherwise, or where we have materially failed to deliver the product.
How we measure "content accessed". Access is recorded by the LMS. "Accessed" means one or more of the following actions has been logged for your account: opening a lesson page, starting or completing a video, opening a downloadable file, attempting a quiz, or posting in the community area linked to the course. A preview of the outline or trailer on the public product page does not count.
How to request a refund. Email [email protected] from the address on your order, with subject line "Refund request — order #[number]". We will acknowledge within 5 Business Days, verify your LMS activity, confirm which tier applies, and refund the corresponding amount to your original payment method within 14 days of our approval. For cryptocurrency purchases, refunds are issued in EUR to a bank account or card you provide.
This does not limit your mandatory consumer rights. If the law of your country of residence in the EU/EEA gives you a stronger right (for example, a different withdrawal period or a longer remedy period), that stronger right continues to apply.
Online ELP Tests
- Cancellation more than 72 hours before the scheduled exam: full refund.
- Cancellation within 72 hours of the scheduled exam: no refund. One free rescheduling is permitted with at least 72 hours' notice.
- No-show without prior notice: no refund.
- Technical failure attributable to Peak Aviation: full refund or free rescheduling at your choice.
In-Person ELP Tests (Sofia)
- Cancellation more than 7 days before the scheduled exam: full refund.
- Cancellation 3–7 days before the scheduled exam: 50% refund.
- Cancellation less than 72 hours before, or no-show: no refund.
- One free rescheduling is permitted with at least 7 days' notice, subject to examiner availability.
5.4 Cancellation by Us
If we cancel a product or service due to insufficient enrolment, instructor unavailability, or regulatory changes, you will receive a full refund within 14 days. We are not liable for any other costs you may have incurred in connection with the cancelled booking (e.g. travel, accommodation, or annual leave).
5.5 Refund Processing
All refunds are returned to the original payment method within 14 days. For cryptocurrency payments, refunds are issued in EUR to a bank account or card that you provide, as cryptocurrency transactions are irreversible.
Article 6 — Online ELP Examination Terms
6.1 Technical Requirements
To participate in an online ELP examination, you must have:
- A stable internet connection (minimum 5 Mbps upload and download)
- A functioning webcam and microphone
- A quiet, private space where no other persons are present
- A valid, in-date government-issued photo ID (passport or national ID card)
It is your responsibility to ensure your equipment and environment meet these requirements before your examination. We are not responsible for examination failure or termination caused by technical issues on your side.
6.2 Examination Conduct
The examiner may terminate the examination and void the result, without refund, if:
- A third party is present in the room or providing assistance in any form
- You are unable to verify your identity to the examiner's satisfaction
- Technical conditions on your side prevent proper administration of the examination
- Your conduct violates examination integrity — including but not limited to use of notes, scripts, earpieces, or AI assistance tools
6.3 Results
Examination results will be communicated to you by email within 10 Business Days of the examination date.
6.4 Documentation
Where you achieve a passing result, we will issue documentation suitable for submission to your National Aviation Authority (NAA). We do not guarantee acceptance by any specific authority. It is your responsibility to verify the current requirements of your NAA before booking.
6.5 Recording and Privacy
By booking an online examination, you consent to the session being recorded for quality assurance, regulatory compliance, and fraud prevention purposes. Recordings are retained for 12 months from the examination date, unless a longer retention period is required by applicable law or regulatory authority. Details of how recordings are processed are set out in our Privacy Policy at www.peakaviation.eu/privacy-policy.
Article 6A — In-Person ELP Examination Terms (Sofia)
In-person English Language Proficiency (ELP) tests are conducted at our Sofia examination location, in partnership with Lenguax s.r.o. (a certified ICAO language testing provider registered in Slovakia). All examinations are administered in accordance with ICAO Doc 9835 standards and applicable EASA and national regulations.
6A.1 Examination Location

Parking and transport information will be included in your booking confirmation email.
6A.2 Booking and Confirmation
In-person examinations must be booked through www.peakaviation.eu. Your booking is confirmed by email. Bookings are personal to you and are non-transferable to another individual.
6A.3 What to Bring
You must arrive with:
- A valid, in-date government-issued photo ID (passport or national ID card). Expired documents will not be accepted.
- Any pilot licence, student pilot licence, or training documentation if specifically requested in your confirmation email.

6A.4 Attendance and Punctuality
Please arrive at least 15 minutes before your scheduled examination time. If you arrive more than 15 minutes late, the examination may be forfeited at the examiner's discretion, with no refund. If you anticipate being late, contact us immediately at [email protected] or by phone (number in your confirmation email).
6A.5 Examination Conduct
The examiner may terminate the examination and void the result, without refund, if:
- You fail to present a valid, in-date photo ID
- Your conduct violates examination integrity (e.g. use of notes, scripts, or communication devices)
- You are visibly under the influence of substances that impair your performance
- A third party attempts to interfere with the examination in any way
6A.6 Results and Documentation
Results will be communicated by email within 10 Business Days of the examination. Where you achieve a passing result, we will provide documentation suitable for submission to your National Aviation Authority, issued in accordance with ICAO Doc 9835 and applicable national regulations. We do not guarantee acceptance by any specific authority.
6A.7 Examiner Substitution
Examinations are conducted by a certified ICAO language proficiency examiner. We reserve the right to substitute the assigned examiner with another qualified examiner where necessary (for example, due to illness or an unforeseen scheduling conflict). In the event that no qualified replacement is available, you will be offered either a rescheduled appointment at no additional cost or a full refund.
6A.8 Accessibility and Reasonable Adjustments
If you have a disability or medical condition that requires adjustments to how your examination is administered, please contact us at [email protected] at least 7 Business Days before your appointment. We will make all reasonable efforts to accommodate your needs. Where adjustments are requested less than 7 days before the exam, we will do our best but cannot guarantee accommodation.
6A.9 Cancellation Policy
Please refer to Article 5.3 (In-Person ELP Tests) for the applicable cancellation and rescheduling policy.
Article 7 — Your Responsibilities
7.1 Eligibility Verification
You are responsible for independently verifying before purchase:
- Your eligibility for the licence, rating, or certificate you are working towards
- Any applicable medical certification requirements (e.g. EASA Part-MED Class 2 medical for PPL)
- The current requirements of your National Aviation Authority
We do not provide eligibility assessments. If you are unsure whether a product is right for your situation, contact your NAA or an aviation consultant before purchasing.
7.2 No Guarantee of Outcomes
Completing a Peak Aviation course or passing a Peak Aviation examination does not guarantee the award of any licence, rating, qualification, or employment. Licensing and certification decisions are made solely by your competent National Aviation Authority, not by Peak Aviation.
7.3 Account Security
You are responsible for keeping your account login credentials confidential and for all activity under your account. If you suspect unauthorised access to your account, notify us immediately at [email protected].
7.4 Prohibited Conduct
You must not:
- Share your login credentials or grant access to your account to any other person
- Reproduce, distribute, record, or commercially exploit any course materials or examination content
- Use AI tools, scripts, note sheets, or any third-party assistance during examinations
- Engage in any conduct that disrupts, defrauds, or undermines the integrity of our programmes
Any breach of this clause will result in the immediate suspension of your access without refund. Serious breaches may be reported to the relevant National Aviation Authority or law enforcement.
Article 8 — Intellectual Property
8.1 All course content, materials, brand assets, examination questions, software, and other intellectual property are owned by Peak Aviation FZC LLC or licensed to the relevant contracting entity. Nothing in these Terms transfers any intellectual property rights to you.
8.2 On payment, you are granted a personal, non-exclusive, non-transferable, revocable licence to access and use course materials solely for your own personal training purposes during the applicable enrolment period.
8.3 We reserve the right to apply technical protection measures, including digital watermarking, session tracking, and access controls to protect our content.
8.4 If you submit feedback, suggestions, or ideas about our products or services, we may use them freely and without any obligation or compensation to you.
Article 9 — Data Protection and Privacy
9.1 We process your personal data in accordance with the EU General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) and applicable Bulgarian data protection legislation.
9.2 Our Privacy Policy (available at www.peakaviation.eu/privacy-policy) sets out in full what personal data we collect, why we collect it, how long we keep it, who we share it with, and how to exercise your rights. By purchasing a product, you confirm you have read and understood our Privacy Policy.
9.3 Your rights under GDPR include the right to: access your data, have inaccuracies corrected, request erasure, restrict or object to processing, and receive your data in a portable format. To exercise any of these rights, email: [email protected].
9.4 You have the right to lodge a complaint with your national supervisory authority. In Bulgaria: Commission for Personal Data Protection (CPDP), www.cpdp.bg.
9.5 Where personal data is transferred outside the EU — for example, to Peak Aviation FZC LLC in the UAE — we ensure appropriate safeguards are in place, including EU Standard Contractual Clauses (SCCs) under GDPR Article 46.
Article 10 — Limitation of Liability
10.1 Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot lawfully be excluded or limited under applicable law (including EU consumer protection law).
10.2 Subject to clause 10.1, our total liability to you in connection with any specific product will not exceed the total amount you paid for that product.
10.3 We are not liable to you for:
- Any decision made by a National Aviation Authority regarding your licence, rating, or application
- Any examination or assessment outcome
- Any career, employment, or commercial consequences
- Any indirect, consequential, or special loss, including loss of profit or revenue
- Technical failures caused by your own equipment, internet connection, or third-party platforms outside our control
10.4 Force Majeure
We will not be liable for any failure or delay in performing our obligations where such failure or delay is caused by events genuinely beyond our reasonable control. These may include, but are not limited to: natural disasters, pandemics, government action or regulation, regulatory changes affecting aviation training, strikes, third-party platform outages (such as Kajabi or Stripe), or widespread internet disruptions.
Where a force majeure event prevents us from performing, we will notify you promptly and, where performance is ultimately impossible, offer either a rescheduled date or a full refund for the affected product.
Article 11 — Governing Law and Dispute Resolution
11.1 These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria.
11.2 EU Consumer Rights: If you are a Consumer resident in an EU member state, the mandatory consumer protection laws of your country of residence apply to your benefit in addition to Bulgarian law. Nothing in these Terms removes or restricts rights that cannot be waived under your local consumer protection legislation.
11.3 We hope to resolve all disputes quickly and amicably. Our process is:
- Step 1 — Contact us: Email [email protected] with your complaint. We will acknowledge within 2 Business Days and aim to provide a resolution within 14 Business Days.
- Step 2 — Alternative Dispute Resolution: If we cannot resolve the matter directly, we invite you to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr, or to contact your national consumer protection authority.
- Step 3 — Courts: If a dispute remains unresolved, it shall be referred to the competent courts in Sofia, Bulgaria, without prejudice to your right as an EU Consumer to bring proceedings in your country of residence.
Article 12 — Changes to These Terms
12.1 We may update these Terms from time to time to reflect changes in our products, services, or applicable law.
12.2 For material changes (those that meaningfully affect your rights or obligations), we will give you at least 30 days' written notice by email to the address you registered with us.
12.3 If you do not accept a material change, you may cancel your enrolment before the change takes effect. Where you have prepaid for unused access, we will provide a pro-rata refund.
12.4 Continued use of our services after a material change takes effect constitutes acceptance of the updated Terms.
12.5 The current version of these Terms is always available at www.peakaviation.eu/terms-and-conditions. The version date at the top of this document confirms which version applies to your contract.
Article 13 — Contact and Complaints
13.1 We take all complaints seriously. Our aim is to acknowledge every complaint within 2 Business Days and provide a substantive response within 14 Business Days.
